Hmm, with the police assessing the case at "the food bar" it sounds like this was at the local "Drink 'n Dine 'n Then Drink Some More while a Movie Happens to be Playing" place that is about a block away from the "real" Cinemark theater? ;-)

I drive through Webster, TX on my way to work each morning; it is a Houston suburb literally just down the street from where I live. Hadn't heard about the incident locally here, and it is oddball enough that it ought to have made the drive-time morning radio show news. I'll sure listen tomorrow.

FWIW, a quick internet search found this reference about assault as defined in TX state law:

TEX. GOV’T CODE § 311.011(b). Under Texas Penal Code section 22.01, a person commits an assault if he:

(1) intentionally, knowingly, or recklessly causes bodily injury to another, including the person’s spouse;
(2) intentionally or knowingly threatens another with imminent bodily injury, including the person’s spouse; or
(3) intentionally or knowingly causes physical contact with another when the person knows or should reasonably believe that the other will regard the conduct as offensive or provocative.

Item (3) notwithstanding, IF Ms. Clayton's role in the fracas wasn't larger than portrayed by the paper from her hometown and if she has the sympathetic off-duty policeman as a witness, I'd like to believe that even the local siren-chasing lawyers could get her case dismissed outright.

Of course this whole incident is ridiculous, but the right thing for Ms Clayton to do would have been to report the loud-mouthed moo-moo mamma to the theater management and let THEM handle it rather than personally challenging an offensive and "very large" woman whilst visiting her grazing land.

Plus it's Texas. Doesn't everyone carry a gun by law there?

Well, its still Texas.... Its been handled wrongly on both counts. Yet... Its Texas. I'll never holiday there again as far as I'm concerned.

This story did make yesterday's drive-time radio here in Houston. The only additional info was a mention that the Australian woman said where she comes from, a tap on the shoulder isn't considered offensive.

I wonder when it actually happened, how she got such a quick court date, and whether it affected her further travels? Maybe if I get ambitious I"ll see if I can find any further info locally.

Leo, I'm not a native of TX and do poke fun at it all the time...but if you're serious, then you'll need to stay home because odd stuff happens everywhere. Although maybe a little more in TX. If you are going to get arrested for assault, for just tapping somebody... you might as well use a tire iron. It gets the point across more clearly.

I just hope the other lady get's the book thrown at her for disorderly conduct. As far as I'm concerned if you answer your phone in the middle of a movie you wave all of your rights, I probably would have thrown popcorn at her.

Ironically, the very day I read that story I went to the theatre and I had to contend to that OTHER audience annoyance: woman eating extremely crinkly bag of popcorn. I couldn't believe how loud this woman was. Not just in her explorations of her bag (like she was searching for that one golden nugget - that one perfect kernel) but also her large crunching. And I couldn't believe that one could take an entire movie to eat one bag of it. Man, I go through y popcorn before the previews have ended. Someone I was with leaned over and asked her to quiet down - which she did, for only five minutes. Then it was back to CRINKLE CRINKLE... CRAUNCH CRAUNCH.

This is the reason I rent movies, I have a large television, enough audio to rattle my windows and I don't give a way 10% of my paycheck to be annoyed. It's rare I can go to the movies and not have some crap like this happen.

This is just so sad. Somehow I think that when I was younger it wasn't so bad. It's like now too many people think it's funny to prevent other people from enjoying a movie or maybe they just don't aren't taught any manners. I don't get it.

I think there should be a law where you could just call the cinema security and if he cought the person on the act of being obnoxious he would just escort the person out with no reimburse. That, or legalize the use of tire irons in such situations... :)
