Recording is a work of the US government. Arrangement is a work of the US government. The music and lyrics were penned in 1772.

When I requested licensing for use in a non-profit production, the publisher of the audio CD says:
"We provide our recordings free of charge to our patrons to enjoy in the manner in which they choose. However, we cannot specifically give or deny permission for, or endorse, any specific use of those recordings. Many of our patrons choose to use our music in a video or audio production. For those who do this, the legal issues surrounding that use are up to them to determine."

Can I use it in a web download? Public performance?

In general, things produced by the USG are public domain.

But is it a "government recording", or did someone else record it? It might fall into the same thing news does..."yes, a public event, but *we* recorded it so that recording is *ours*. Bwahahahaha."
