Agreement for use of other people"s footage
I've tried to search the forum, but have not found anything that seems to answer this situation (By the way, thanks for the FAQ's - Great)
I'm producing a short video for a not-for-profit organization. I found someone who has a commercial, instructional video that has some scenes I need and are unable to get on my own. She (the owner/producer/copyright holder) of the video has agreed to allow me to use short clips in exchange for a credit, as long as it is for this one-time use only. Can someone point me to a sample agreement that will cover this situation. I want to protect both of us. Thanks |

I haven't seen any pre-made contracts that cover this specific thing. The professional move is to consult a lawyer and have him draft up a contract between the two of you. If you want to wing it on your own, I would take one of the release forms in the FAQ and modify it to your needs. It won't offer you nearly the same protection in court as a specificaly tailored one would, but its free.

Thanks Dylan, I would have thought this would be a common situation ie. making use of another's clips. Any of the stock houses have agreements that I could look at to get a few hints?

It probably is, but people don't often put out a contract for public use that they had to pay a lawyer $500 to write.
