i river power problem

Hi all,
I just got a iriver790. I"m useing a Sony lav mic with it. When I bought it from B&H last week it looked great. After fooling around with it for a few min. I got great audio for voice recording. Last night, at a wedding, however I had a problem turning it on. I had my wireless as a back up (thank the video gods!!!) but was very upset about this. I changed the battery, pressed, clicked and held the play/power on button but still nothing. I also made sure the hold button wasn't on.

Today after playing with it a little bit I got it to work again. Again there was no power at all, no light, no start up, nothing. I think it's a power/battery issuse cause if I take out the battery and put it back in it's about 50% chance it'll work. I've used two brand new batteries. Should I send it back? I tossed the package so I would have to deal with iriver and not B&H. Has anyone had a simlar problem?
